Suspended Deputy National Police Commissioner Shadrack Sibiya’s attorney has told the Randburg Magistrates’ Court that Mr M should have been charged with human trafficking and not Sibiya.

This was heard during day three of Sibiya’s bail application. Sibiya was arrested last week on charges of rape, human trafficking and the alleged sexual grooming of a 16-year-old girl.

A new charge of contravening the Firearms Control Act has also been added to his charge sheet. Sibiya’s attorney, Amanda Nel told the court that her client was never at any point involved in human trafficking. “What Mr M did, and I will get back to that, fits and falls within the ambit of human trafficking himself and I am going to show that to you. But the point needed to be made clear is up until this point the applicant was not involved in any activity related to human trafficking.”

The Randburg Magistrates’ Court has heard that the victim who accused suspended Deputy National Police Commissioner Shadrack Sibiya for rape, was unconscious at the time of the alleged incident. This was revealed during cross-examination of the state’s first witness, police sergeant Ndlovu, who is the investigating officer in the case.

Sibiya’s attorney Amanda Nel at cross-examining Sergeant Ndlovu (first name withheld) and said, “So this is what I was going to. MC was so out of it that she didn’t even know the perpetrator. She doesn’t know, she can’t state that it was the applicant that raped her. Not so? Your worship it was the applicant who plied liquor to the victim and the victim passed out eventually and evidence does say as per the applicant himself says, he stayed behind in the room and yes the victim because of passing out advantage was taken of her.”
